The Franchise Disclosure Season has started.
Franchisors will need to update the following prior to 31 October 2023:
1. Disclosure Document;
2. Key Facts Sheet; and
3. Franchise Disclosure Register.
This year, Franchisors should be reviewing their Franchise Suite of Documents to remove any Unfair Contract Terms. From November 2023 Franchisors could be liable for a penalty up to $50 million if they include Unfair Contract Terms in their Suite of Documents.

On 7 March 2023, the ACCC outlined its compliance and enforcement priorities for 2023 and 2024.
It specifically mentioned franchisees and in a media release today stated:
“The introduction of new laws prohibiting unfair contract terms that include a new penalty regime later this year would be an important change for consumers and small business and would also play an important role in the ACCC’s enforcement priorities.”
